yes. ur 140 is still valid. you don't need paystubs from company A, but its better to be working for company A the time you are filing 485 with them to make your case more authentic.

Can people convert LC pending in BEC to PERM? If So, how safe it is and how much time it takes totally.
Yes, and its well known. Talk to or just visit Murthy or Immigrationportal and you will find lot of discussion on this topic. In a nutshell, as long the PERM application is identical to BEC pending application you can convert to PERM. Make sure to find an attorney familiar in such type of cases.

I entered usa in H4 visa in july 2008 , while my H1 was applied from india in april 2008 ,and H1 got approved . now my employer is forcing me to do COS(H4 to H1) or go to india for stamping because he can't hold my H1 in a approved state so long . due to current market condition and so many rejections i am afraid to go for COS . He is asking $2800 only for regular COS processing !!!! thats too high , he is going to file fresh H1 petition I129 along with COS I539 .

instead of applying fresh H1 petition i.e I129 , since my H1 is already in approved state so can i apply only I539 for changing my status ?

Can I change to different employer while the i140 is pending and also keep the PD. What i would like to do is..i want to change to a different employer and ask the present employer to keep the i-140 process as it is.
Is it ok if the i-140 gets approved while i no longer work for that company. I understand if i get any RFE, then employer need to respond accordingly.

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

If I-485 is filed improperly, the application can be rejected and we need to resend again, however if the date move back, we will be stuck for years again.
What are the basis on which USCIS will reject the application, when the lawyer apply the application, what kind of evidence we should be double checking in our side, so that we do not have any potential for rejection.
If the fees are correct, if the forms are signed, all the initial evidence is provided? These are good enough to guarantee the acceptance of application.

On July 20, 2010, the House of Representatives passed, by voice vote, the International Adoption Harmonization Act of 2010, to amend the Immigration and Nationality Act with respect to adopted alien children.

The current age limit is 16. The bill would also restore an international adoption exemption that was inadvertently eliminated when the U.S. joined the Hague Convention on Intercountry Adoptions.
The bill was sponsored by Immigration Subcommittee Chairwoman, Zoe Lofgren (D-CA).

a.) DO you need latest paystubs for filing for 485.
Suppose, i am working for company A and company B has filed for my GC, then how can this be provided.
b.) Even if i am working for company A, do i still need pay stubs or will a letter stating that "this job is available for the immigrant" suffice.

hi all,
I've found myself in abit of a predicament. My application for H1B extension is still pending (filed in September) and all I have right now is a Notice of Action from the immigration department.
While waiting, I have been laid off this week... I intend to return back to my home country before my last day (Dec 31).
My question is: Would I be able to make a round trip? That is to say, come back to the US on a tourist visa a week after I got home? I need to come back to sell what I own here and settle other things.
A friend told me that it is better to overstay for however long (maybe an extra week, I don't plan on too long) I need to get my things in order than try to take the chance of coming back. What do you think?
I appreciate any advice you can give.
