Would really appreciate if some one can answer this question.
Is it possible to movie from H1B to EDA (valid unitl Oct 2010), work part time on EAD to complete Master's degree and then move back to the same employer to continuing working full time on H1B?
(assuming current employer is willing to allow going part time)

Hi friends,
I got my I-140 approval in premium processing. But unfortunately, USCIS printed the new labor filing date (2010) when the attorney requested my I-140 to capture the old priority date which is June2004. My law firm already contacted USCIS to issue a revised notice with the old priority date (June2004).
How long does USCIS take to issue a revised I-140? Any feedback is greatly appreciated. Anything that we can do to expedite the release of the new I-140 notice with correct priority date?
Please let me know when you get a chance

You can do anything (including doing nothing). However it is the norm to work for the sponsoring employer (or the latest employer if you used AC21) for 6 month to 1 year to ensure that no question arises in future regarding the legitimacy of the job offer based on which your GC was approved.

Do note that AILF does cover people who were eligible to file in July but did not file due to USCIS/DOS revised bulletin.....However, it is unknown at this time what the outcome of the lawsuit would be for July applicants vs eligible but non-applicants as the decision is at the discretion of the Judge.....

Question: If the I-140 is pending and not yet approved and I filed for I-485, will I receive Fingerprint Notice or I-140 approval is needed before Fingerprinting?

USCIS has specifically answered a very similar question in 2004. The answer is "A change of status take effect automatically on the effective date noted in the [approval notice], even if there is an intervening admission...."
Your H-1B status should therefore take effect automatically on 10/1/09, assuming it was approved as a change of status.
