My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?

My situation is not very urgent, but I like to stay on top of things. Thanks in advance for your help, it is much appreciated.
My F1 visa expires on July 6 of 2011. However, I have an I-20 that permits me to stay in the United States until August 31st of 2012. The reason for this is that I came here as a master's student, but transferred to a PhD program. This is my second I-20.
I have plans to leave for India in May of 2011 and stay until end June 2011. Will it be necessary for me to apply for an F1 Visa extension? Technically I'll be back by July 6, but will it be problematic to get back without a renewed visa because there are only a few days remaining on the old visa? Again, as per the I20 I can stay legally here until August 2012. Is it difficult to renew the F1 visa? All this is almost a year from now but I'm getting quite stressed about the situation. I cannot certainly finish my degree by July 2011.

Employer A - LC applied in Dec 07, Currently on 7th year extension till Jan 2010. Stamped visa.
Employer B wishes to recruit me by transfer H1-B and utilize recapture time. The total time they would get is till Apr 2010 (which includes recpature time) along with 7th year I-797.
Employer B wishes to file LC 1 month after I join them.
Assuming that I join them by end of Dec 2008, I have the following questions about my H1-B extension

My law school roommate and long time friend Henry Olsen is the vice president of the conservative think tank the American Enterprise Institute. He's written an essay for the National Review entitled "The Way of the Whigs" and it talks about the danger the GOP faces in terms of long term survival. This might seem strange given the recent polling problems the Democrats have experienced, but Henry writes that there are long term forces at work that Republicans need to heed. I got my H1-B visa on June 29, 2005 , I came to india on Jan 2009 . From Jan 2009 till now I have been staying in India , bcoz I was taking care of my new born daughter, now she is grown up and now I am planning to start working in US. Right now I got my H4 visa .
I came to know from someone that H1-B filing for this year was over in Jan 2011, so if I need to file a new H1-b , I have to file now and I will be eligible to work after Oct 1 this year. Is it true ? Is it not possible that a company files for a new H1-B under premium processing and I start working after 2 weeks of filing ? I don't want to wait that long(Oct 1) to work , I have few oppurinities coming up where I may get selected.

Hi,
My L1B visa & petition with Company A runs upto Sep this year.
I'm applying for H1B petition with company B this year.
my current Company A will try to go for L1B petition extension, so that I can continue being here beyond september.
My concern is if these 2 will clash with each other ?
One of my friends said that whichever petition gets approved latest - will be the one that holds good.
So if L1B extension gets approved after h1B, will that negate H1B ?
and vice-versa ..

Ominously for Republicans hoping to hold the White House and recapture Congress next year, Bush's support has plunged among core GOP groups like evangelicals, and pivotal independent swing voters.
Congress is doing about the same. Like Bush, lawmakers are winning approval by roughly three in 10. Such levels are significantly low for a president, and poor but less unusual for Congress.
"The big thing would be the war," said independent Richard MacDonald, 56, a retired printer from Redding, Calif. "I don't think he knew what he got into when he got into it." As for Congress, MacDonald said, "It's just the same old same old with me. A lot of promises they don't keep."
Bush was risking more unpopularity by commuting I. Lewis "Scooter" Libby's prison term in the CIA leak case, and his refusal to rule out a full pardon. Polls in March after the former White House aide's conviction showed two in three opposed to a pardon.
The public's dissatisfaction may be more serious for Republicans because even though Bush cannot run again, he is the face of the GOP. He will remain that until his party picks its 2008 presidential nominee - and through the campaign if Democrats can keep him front and center.
"Everything about this race will be about George Bush and the mess he left," Rep. Rahm Emanuel, D-Ill., a member of the House Democratic leadership, said about 2008. "He'll be on the ballot."
Congress' numbers could signal danger for majority Democrats, since they echo the low ratings just before the GOP 1994 takeover of the House and Senate, and the Democratic capture of both chambers last November.
But unlike the president, Congress usually has low approval ratings no matter which party is in control, and poor poll numbers have not always meant the majority party suffered on Election Day. Voters usually show more disdain for Congress as an institution than for their own representative - whom they pick.
A majority in a CNN-Opinion Research Corp. survey in late June said Democratic control of Congress was good for the country. Yet only 42 percent approved of what Democratic leaders have done this year - when Democrats failed to force Bush to change policy on Iraq.
Republican strategists hope the dim mood will help the GOP in congressional elections.
"The voters voted for change and they expected change, and they see an institution still incapable of getting anything done," said GOP pollster Linda DiVall.
The abysmal numbers are already affecting how Bush and Congress are governing and candidates' positioning for 2008.
Last Thursday's Senate collapse of Bush's immigration bill showed anew how lawmakers feel free to ignore his agenda. Republican senators like Richard Lugar of Indiana and George Voinovich of Ohio have joined increasingly bipartisan calls for an Iraq troop withdrawal.
This year's GOP presidential debates have seen former New York mayor Rudy Giuliani, Arizona Sen. John McCain and others criticize Bush or his administration for mishandling the war and other issues. Some Republican congressional candidates have not hesitated to distance themselves from Bush.
"President Bush is my friend, and I don't always agree with my friends," said Sen. Gordon Smith, R-Ore., facing a tough re-election fight next year. "And on the issues of Iraq and immigration, I simply disagree with his approach."
Bush's doleful numbers speak for themselves.
In an early June AP-Ipsos poll, 32 percent approved of his work, tying his low in that survey. Other June polls in which he set or tied his personal worst included 27 percent by CBS News, 31 percent by Fox News-Opinion Dynamics, 32 percent by CNN-Opinion Research Corp. and 26 percent by Newsweek.
The Gallup poll's lowest presidential approval rating was President Truman's 23 percent in 1951 and 1952 during the Korean war, compared with Nixon's 24 percent days before he resigned in August 1974. Bush notched the best ever, 90 percent days after the terrorist attacks of Sept. 11, 2001.
The AP's June survey showed that compared with an AP exit poll of voters in November 2004, Bush's approval was down among swing voters. His support dropped from about half of independents to a fifth; from half to a third of Catholics; and from nearly half to a fifth of moderates.
Among usually loyal GOP voters, his approval was down from about eight in 10 to roughly half of both conservatives and white evangelicals.
Congress had a 35 percent approval rating in a May AP-Ipsos survey. Polls in June found 27 percent approval by CBS News, 25 percent by Newsweek and 24 percent by Gallup-USA Today.

I recently got a denial on my audited labor case after 2 years of wait. I had already applied my H1-B 8th year extn on the basis of my pending labor in premium mode. My luck was such that my labor was picked up and denied a day after the H1-B extn was filed.
Questions?
Since the basis of the H1-B extension was pending labor, I think USCIS will reject the extension unless I get lucky.
If I appeal against the denial, is it possible to go back to USCIS to give the H1-B extension on that basis?
DOL site says "standard appeals" is Aug 2007. Does this mean cases of 2007 or appeal filed in 2007 for an earlier denial?
Reason for denial of labor:
Company name was not filed in job advertisement
Job location not specified in the ETA form.
These seem too trivial but nevertheless they sent this in the denial.

Hi All,
I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.
Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?
