    I had a H1b visa but never travelled to US.My visa got cancelled without prejudice when i left the organization.My new employer filed l1b individual on my behalf.i129 was denied stating that i am a skilled worker but do not possess specialized knowledge.Moreover the position in US is that of a software engineer & does not require any specialized knowledge.Please note that I hold a Bachelor of Engineering degree(BE) in Electronics & Telecommunications with about 5 years of IT experience.

    Does this mean my visa is denied?
    What options do i have next?
    Will this affect my further applications?

    You can extend status while living at US, but for re-entry after international travel (after November 26, 2009) you must get the visa stamped on your passport.

    Hi All,
    We [Me(applicant) and my Wife(H4)] finally received our EAD's last week from NSC :> I have 2 questions:

    1. Can i work part time.....apart from my 8 to 5 job based on my EAD. If yes, does the part time job need to be related or similar to my 8 to 5 job?

    2. We had our FP done before we got our EAD's. Do we have to go back for additional FP after receiving EAD's? Anybody with similar situation?
    Appreciate everyone's time.

    Hello all,
    Form I-693 downloading from the following site is valid until 6/30/07.
    Is it ok to use this form though we will be filing the I-485 on 07/01/07.

    As long as you get your medicals done before 6/30/07 you should be fine.

    Hi ,

    My wife has H1 visa approved under Consular Processing from Company A, so she is still under H4. She got another offer from Company B so we applied for another H1B before H1B quota expired. It is under process.

    1 ) we applied for COS from H4 to H1 By Company A by premium processing.

    2 ) Company B H1B from H4 is also under process.

    Does the order of outcome from either petetions affect another petetion. For example if companie A petetion is approved and then afterwards company B petetion is rejected. will she be in H1 status.

    Dear All,
    I have a question regarding the H1b visa quotas.
    The USCIS website stated on April 20th that they are still accepting applications as the H1 quota of 65000+ 20000(Masters) was not full.
    Does anyone have any information about the latest news in this regard?
    Has the cap been met or are they still accepting applications?

    I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?

    gurus please advise.

    Folks,

    Here's one question I have which I haven't see in any forums so far (perhaps its lurking somewhere .. who knows) ... let me get to the point.

    When filing for AOS/485, if the I-140 that was filed prior to filing AOS was pending and gets approved AFTER 485 was filed... should we explicitly inform USCIS that that 140 was appoved ?

    I guess USCIS should have that information (of course!) but I am not sure if we should be pro-active and make sure we inform the service center that the 140 was approved ?!

    hi, my wife's ead expired in 2008 and did not get it renewed as she is a housewife and is not going to work. we got her ap renewed thouht and travelled out of usa. my question is when we re-enter usa will the port of entry officials ask for a valid ead for my wife for allowing re-entry. or just valid ap is enough for re-entry.
