Hi,
I lost my original passport and was issued a new passort which is valid till 12 feb 2007. I mailed my application to the indian consulate but they stamped the extension of passport for 1 more year. The first page of the passport say it expires the on 12th feb but on the next page th consular general stamped the extension of the passport till 12th jan 2008. I am goin to india on 26th jan for H1b stamping. I wanted to know what are the chances of the visa getting rejected at the US embassy. Alsp is the passport valid for travel

Hi,
My H1B is with USCIS and my employer has received an intent to revoke.
I am planning to go on H4 and my questions are
1) Can my employer file for a new H1B ANYTIME regardless of whether my H1B is revoked or not? I heard that since i am already counted against the cap, it doesnt matter when the H1B is filed, once approved i could start work immediately. Is this true?
Or this can be done only till my earlier H1B is not revoked? And if revoked i will have to file H1B against the 2011 quota and start work from October?

I have a valid Visitor(B1/B2) visa stamp in my passport. I previously entered the country on H1B visa stamp which has already expired. Can I come back to US based on the valid Visitor(B1/B2) visa stamp?

Hi Guys,
I used to work for company �a� which was a part of the bigger company �A�. There was another company �b� which was a part of the bigger company �B�.
Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.
Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�
Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. That's roughly the typical weekly usage we saw last year and if the pace doesn't change much, the cap will potentially be hit one to two months later than for FY2011. I am initiating this poll to find out priority date segments, as I could not found a poll for priority dates tracking.
I have divided priority dates in eights segments. From the eight segments, I have created three specific segments from Jan 2004 to June 2004, June 2004 to Dec 2004 and Jan 2005 to March 2005. The people in these segments are most likely to get their GC (If USCIS process in FIFO manner) as soon as the backlog with priority dates before 2003 is cleared. The first three months of 2005, Jan to March, when lots of people applied, just before a new PERM labor certification process was introduce. This will help separate the three months from the rest of the year 2005.
Please join me to track priority dates which is the key date for GC approval.

Can anyone throw some light on this query...
I presently work for a cap excempt employer and now looking for employer who could file for my h1b under cap subjected in the month of april witha start date of oct 2008.
I would like the new employer to file my visa in such a way that, i could still continue with my present full time job even after oct 2008. Based on what i have understood, i guess if the new employer files as "COncurrent H1b" then i can join him at my wish after oct 2008 provided new emplyer has not revoked my h1b. Am i right..???
Also ..how many concurrent h1b can i have at a time..???
I don't want to miss this year quota, so want to make sure i take all precaution to get h1b cleared.
Greatly apprecite inputs...

My I-485 was filed this July. My wife and I got FP notices for Nov 20. But my wife is currently in India and I will be in India too on Nov 20. So we will have to reschedule at least for my wife.
My question is, has anyone who filed their I-485 after July 2 rescheduled their FP appt and got a new appt date? I'm in the San Jose area.

The date I am planning to schedule is still not showing as available. My question
is can I enter all my data and save it and once the date shows up, can I select
the date? How does it work? If not do I need to enter all the data on the day

Currently am on H1 with GC Sponsoring company. I have also filed my I 485 in July 07.
I have got a contract project interview with a prominent company. But I was told that I have to be on W2. I am not clear what does that mean.
Does it mean that I have to move over to EAD if I get the offer?
Can I still work with the sponsoring company and be on w2 for the contract. I am not sure what is correct way of going with the offer. Can some one help me understand this?

Hello,
As we know, from January 1 2010, all the prevailing wage (PW) determinations have to be sent to DOL. My PW was submitted on March 1 2010 and I still have not got the determination. Can someone tell, how long is it taking on an average?

I'm on H1 on 8th Year Extension,Got a nice offer from a company, which is not large company, but projects they have are very long term projects I applied for 485 long timeback, but did not applied for my spouse , who is on H4 , applied for H1 which will be validated from 1st Oct'06.Can I switch the company now and start using EAD and apply for my spouse when my PD becomes current , or wait with the current employer till I apply for 485.
Need SUggestion.
