EB-3 won't need help when everyone else is done because the only people left to allocate visas would be EB-3 only . I guess we are just in for a long long wait.
That situation never occur. EB2 is going to be always filled up. No one is going to apply in EB3 in future and all in EB2, so all will go to EB1,EB2.

I would suggest to read this thread completely to anyone who is AOS candidate. Even if you are not thinking of changing your job, during current economy, anyone should be prepared to use AC21 if needed.

I have faxed my letters...sent 7 by USPS as well to get a hard copy reply. I do not want to discourage this effort, but In my opinion NOTHING will happen with Fax/Email as these are the people who show that they recognize the problem and working the best way they could. No room for improvement.
I do not think lawsuit will work either. Courts are goin to believe all the plans and implementation details and success stories from DOL.
I met 2 members of Congress ( one Ex)and they heard me patiently, appreciated me explaining the problem to them, showed their empathy but no results. One of them I guess was instrumental for the fillibuster the Spector's bill...Great...I do not blame anybody..I realized later that If someone is elected based on conservative ideology and Xenophobic attitude, how is s/he going to help me.
I was impressed by the rallies the illegals aliens have organized. That definitely had major impact as a community asking for their rights. It was covered in all Major /Minor channels and almost all major radio station. It had a major impact in congress hearings. A force to recon with.....
We are all high skilled people who I think,
-do not have time to go out for rally,
-have enough time for suggestions to others in this and other forum(internet is great),
-do not want to participate or donate for a lawsuit,
-always think about divisions among ourselves (01 & 02 Vs 03/04 devide),
-wish to take meanigless positions (stopping PERM..Cursing IV..),
-believe why to move their butt as they have consistent job and not to worry about the time( If it comes early..its a bonus),
-take and reply to opinions personally
-think others will get benefitted too
-wait and watch (Home country is an option too)
-worry about a day leave for rally or meeting
-wait for Visa Bullettin
-discuss Illegals while we are in worst shape than them
I guess if we do not put our acts together, We deserve the situation we are in today.
I suggest, we make city wise list of the suffering people, meet once in 1 or 2 weeks, choose a lead and have leads finalize the date for the rally/ further action.....and show up.
If NOT, then simply show up at Capitol in white dress after Spring recess of Congress.
Unless somebody comes up with any other viable option, I guess Its a wake up call to be answered. Rally from Jefferson to Capitol via 1600 P. Avenue....We donot need 500,000. Even 30 to 50 people with a week notice to all major TV channels will work.
Since, Illegals had such a great rally, Media will definitely pay attention to LEGAL's rally.
Local folks...Congress works until late..Early morning or after work hour is fine. Not sure abt Saturday. If no one is interested..fine..I have got two hands to display at least one banner.

You stated dual intent immigrants. In letter and spirit.
That contradicts US Embassy provisions of H1 stamping, when you first go for the visa interview. Doesn't the US Embassy/Consulate state that you should be able to prove your intent NOT to abandon your country of origin, show you family ties, financial connections. Am I right? I can give a ton of links from US Consulate web sites with those exact words.
Now, what you are talking is dual intention: get H1B visa and get on the permanent residence highway, at the earliest opportunity.
It's OK to start with an empty kitty in SS and Medicare account, just when are about to get your Green Card than to walk back to your country losing 10 to 20 grand of your own money after 6 or 7 years. Uncle Sam should not collect SS Tax and Medicare from temporary workers. Period.
Although on first reading I was agreeing with the person who indicated that deducting SS and Medicare from non-immigrants does not make sense, lets look at it from another perspective... most of us would agree that more than 50 to 60% of non-immigrants or dual intent immigrants (read H1 visas for the purpose of this thread) are trying to obtain their permanent residency. Now, if the SS and Medicare are not deducted while you are on a H1B (boy, the employers would love this because as per law they have to match your deduction dollar for dollar) and you get your green card, you would be essentially starting with an empty kitty (i.e. the benefits that you would have accrued over the 9-10 years that it took you to get your GC are zero. Now, whose loss is that? I think, the better alternative would be the proposal by Sen. Kyle/Sen. Cornyn where they advocate that a temporary worker who has to go back will get the money when he leaves. If you don't and get your GC done, then the money goes into the SS/Medicare kitty and that way nobody loses.:)

My PD is Dec. 04, and my I-485 was filed during the july fiasco in 2007. My PD was current since March 08 until it will become "unavailable" in June 08.
My attorney got update from Nebraska SC in May stating "Your case is in queue for green card." Now what will happen to my case since EB-3 ROW will be unavailable in June? Does that mean an IO once opened my file after March and will close it without processing any further because of the change in the June Visa Bulletin?
I am confused. Please share your insights and experiences.

Your PD in EB3 for ROW will be back into track in October 2008 as its said in the current visa bulletin dated Jul 2008 for EB3 preference. So once it is back to current in October then the new visa numbers will be alloted. Then you will get your GC. So just wait till October to receive your GC confirmation.

Agree with you, tinamatthew, regarding H1C visa, but my emploier does not want to waist his time for this, the chanses are too slim to get one of 500 H1C..., so I decided not to mention about it.
Maybe.... , the july victory might help, I just hope they will approve my DS230 this time, because previous DS230 was out of date, and they asked to submit it again.
But it is only one case, other nurses are still in the long process with CGFNS, and VisaScreen, then I140, with the huge backlog in the Visa Center , and so on...I am not against all these procedures, I believe it is a necessity, but the long immigration process for nurses is neither fair nor correct from healthcare and economic point of view.
So I believe for the majority of foreign nurses the July VB is not helpful in anyway.
Schedule A is our only option!

Mail your letter and completed Form 7001 to Ombudsman's office and lets see what they do it about it. Please post any responses you receive from Ombudsman's office.

I know 3 friends of mine who got an email for USCIS rearding the GC approval. They all had priority dates around April-June 2004 EB3 India. These are the lucky ones who got labor cleared in 2-3 months (just prior to BEC/PERM) and had filed 485/140 concurrently.

For many of us, today is payday. What better day than today to make your first time contribution. I understand most of the money that we get is earmarked for something or the other. In a few days we again start our long wait for the next paycheck. On CNBC, I heard one commentator talking about consumers and how apt they were to rearrange their expenditure to the changing environment. For us, the environment is pretty static in the Green card world and there is very little change in the last several years.
So I urge you to rearrange your expenditure and contribute and see the environment change.
Please remember I will contribute $25 for each contribution of $100 from a member who is making this contribution for the first time.

My wife's DL renewal is pending for more than 2 months...When we contacted DMV they said its pending clearance from DHS (homeland security) and it could take take 120+ days to get their approval.
