Hi friends

I travelled out of USA and am trying to get back into USA with AP. I am using H1B(not stamped).
THey temporarily transferred to me indian office for this duration.

I also have EAD with me(not yet started to use).Now My co. is not letting me to go back to USA
without a project.If incase i want to change my employer, how can I do it..

Will it hurt to go back without employers permission to USA and then to use EAD to get a job?
After this I plan to submit my resignation.For EAD, 180 days already crossed.

If I want to do the above,how many days I have to get a job with EAD with a new employer after I go to USA?

What are my options?

My I-140 was submitted to USCIS in June, 2006 and got approved in August, 2006 and my employer has received the approval notice. I am checking the case status online but it is still showing up that my case is in pending till date. One of my friends is also in the same situation, his I-140 got approved recently and he received approval notice copy from attroney but the case did not update on the USCIS web site as approved. When I called USCIS, they told me that this needs to be reported by my lawyer and not me. When I talked to my attroney on this, she told me that we don't need to worry about this as the approval notice is available with us. But if the case update showing up correctly, atleast I could show that as a proof for my priority date portability if I switch the employer. Does anyone experienced the same problem and appreciate the suggestion as to how this can be corrected. Thanks in advance.

I received an RFE on my I-140 and we responded back with the company tax statements on Dec 2nd 2007. We saw LUDs on I-140 on Dec 4th, Dec 5th 2007.

There were simultaneous LUDs on 12/12/2007 on my pending 485, my wife's pending 485 and my wife's pending advance parole after the FP LUD. Is it common ?

Today (1/2/208), we checked the status and found that they mailed the Advance parole document for my wife. Note that I got the AP and EAD and my wife got EAD earlier.

Please let me know if anyone faced the similar pattern.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. I am from California. One of the requirement as you all know is Notice of Job posting with SWA. We have a new person in our HR who deals with immigration the earlier one left .
Problem Description: According to our new HR posting jobs on http://www.caljobs.ca.gov/
is equivalent to Notice of Job posting. Can anyone from California confirm if that is true. If there is additional method can you provide the details or any link.

Harry Reid says he's got 60 votes to support an immigration reform bill. That's a pretty confident tone he's taking and I hope he's right. And for those of you who say that you don't have provisions in the bill helping your group - particularly employment immigration advocates - I'll remind you that the immigration reform bill is what is standing in the way of many other bills moving forward. Once it is passed, we should be back in a normal environment where other problems can be more easily addressed.

I sent my EAD application on 10/24(Wednesday), reached NSC on 10/26(Friday), Notice date 10/29(Monday), Check cashed 10/30(Tuesday)..Already got I-485 receipts back in August.

So they are Current now.... But what about those July/Aug filers who are still waiting for their receipts? Very unfair to them. I could wait for 2 months to get my EAD receipt if they could first receipt all july august filers...

They are really unpredictable..

If the new bill gets approved when will it likely take affect? I just had my LC approved today and they are going to file I-140. Before the EB-3 retrogression for all nationalities i was told i-140 an i-485 could be filed at the same time. what impact does the new bill have on my situation?

If your wife is using the EAD obtained after you filed I-485, she is no longer on H4. Technically there is no reason for her to still be on H4 but if you want her to maintain H4 she may need to travel out of country and obtain a new H4 visa with your new approved H1.
Also technically she was not out of status since you spplied I-485 before the previous H4 expired.

Hi,

I Lost my I797A (but having photo copy) . I want to go to my Home country on emergency for 2 weeks and return to US.

Will I get visa stamping with

1. Copy of I797A and Employee's related documents ?
2. Copy of I797A and Employee's related documents + Proof of Duplication Request ?
3. Whether Duplication form (I-824) Should be separately filed for L1 & L2 ?

Please guide me Immediately.

Hi,

I have a question about H1B transfer. I joined a company A on h1b in may 2005 and did an H1B transfer on july 2006 to company B. Now INS has sent an RFE (for company B financial). I have submitted all the relevant documents when I joined company B for H1B transfer so my credentials are crystal clear. Now when the comhpany B sends a response to INS and if H1B does not get approved. Would I be able to do an H1B transfer to any other company. I spoke to one company they are saying that since the RFE is on the company's credibility so they can do an transfer provided if we submit all the paystubs which we got from company B. I have been working for a client and have all the recent paystubs. Please advice.

Hi,

I wanted to now how you guys are going about AP and I94 renewals.

If we use AP to come to US, then our I-94 is valid only for 1 year i.e till AP expires.. So, if we apply for AP renewal, what will happen to I-94? Do we need to renew it? If yes, what is the procedure?

And, If we have a valid H4 visa for 2 more years but started working on EAD, when we enter into US, do we need to use AP for sure or can use H4 as it is still valid? If we use H4, will our EAD become invalid?

Please let me know.

what is the best bet after I-140 denied?
I mean does it make any difference far as 485/EAD if the employer does appeal or MTR?
I mean is there a possibility of keeping the 485 and EAD alive after I-140 denied if employer appeal or Motion to Reopen?
